1. Overview
This Risk Statement describes the risks associated with using Motiw8, participating in challenges, and submitting fitness evidence. It is a mandatory component of the Terms & Conditions.
2. Not Medical Advice
Motiw8 is not a healthcare provider.
Motiw8 does not:
- Provide medical, nutritional, or therapeutic advice
- Diagnose, treat, or cure any condition
- Guarantee that participation is safe for all users
Always consult a doctor before beginning any weight-loss or fitness program.
3. Fitness Risks
Participation in weight-loss or steps challenges involves inherent risks, including:
- Strain, injury, or overexertion
- Adverse reactions to exercise or calorie deficits
- Hydration issues
- Dizziness or fatigue
- Pre-existing medical conditions worsening
These risks are real, and they are part of what you are deciding about when you join a challenge. Go at a pace that is safe for you, stop if something feels wrong, and if you have a health condition, are pregnant, or are unsure whether a challenge is safe for you, speak to a doctor before you start.
Accepting that exercise carries risk is not the same as accepting that we can get things wrong. Nothing here excludes or limits our liability for death or personal injury caused by our fault, for damage caused intentionally or through gross negligence, for fraud, or for anything else that cannot lawfully be excluded.
4. No Guaranteed Results
Motiw8 does not and cannot guarantee:
- Specific weight loss
- Health improvements
- Physical changes
- Challenge outcomes
- Ability to win payouts
Your results depend entirely on your individual effort and physiology.
5. Digital & Technical Risks
We work to keep Motiw8 running and accurate, but we cannot promise uninterrupted or error-free service. What we do and do not promise is set out in Section 9.
Risks include:
- App crashes
- Internet connectivity issues
- Device compatibility problems
- Delayed uploads
- GPS/device inaccuracy
- Health data sync failures
- Evidence upload errors
Users are responsible for ensuring:
- Stable internet
- Functional camera
- Updated device OS
6. Evidence Submission Risks
Submitting photos and videos carries specific risks:
- Incorrect timestamps
- Blurry or unreadable images
- Failed video capture
- Upload interruptions
- Failed liveness detection
- Incorrect OCR reading
- Rejection due to verification issues
- Delays in scoring and ranking
If a technical problem on your side stops you submitting — your own device, internet connection, wearable, or a third-party app — we are not responsible for the outcome. If the failure was on our side, we are. Where our systems fail during a submission window, you have not been disqualified and nothing is forfeited: tell us and we will re-score your entry, or refund your stake in full if re-scoring is no longer possible.
7. Fraud Prevention & Consequences
Motiw8 implements advanced fraud detection, including:
- Face matching
- Liveness detection
- OCR data extraction
- Metadata analysis
- Steps fraud detection
- Pattern analysis
- Consistency scoring
If you violate rules or engage in cheating:
- You may be disqualified
- Stakes may be forfeited
- Your account may be suspended
- Payout eligibility may be revoked
- You may be banned permanently
8. Financial Risks
The app does not provide investment or financial advice.
Users accept the risk that:
- They may lose their stake if disqualified
- They may not win any payout
- Their ranking may change after verification
- Payouts may be delayed due to KYC or technical issues
9. What we promise about the service, and what we don’t
We will provide the app and the challenges with reasonable care and skill. They will be as described in these documents and fit for the purposes you would normally expect. If they are not, you have rights under consumer law, and nothing here takes those away.
There are things we cannot promise. We do not guarantee that the app will be available without interruption, that it will be free of errors, or that data from your phone, your wearable, or a connected third-party app will always be accurate or arrive on time. Where a problem is caused by something we are responsible for and it affects a challenge you are in, tell us and we will put it right — see “Responsibility” below.
10. Responsibility
What we are not responsible for. We are not responsible for loss or damage that was not caused by us, or that we could not reasonably have foreseen when you joined. That includes: injury or health consequences arising from how you choose to train, eat, or exercise; the acts or omissions of other participants; failures of your own device, internet connection, wearable, or a third-party app; and events outside our reasonable control.
Our liability. If we are liable to you for something that goes wrong, the most we will pay in total is the greater of (a) everything you have paid us in the 12 months before the problem arose, and (b) the amount we owe you from any challenge affected by it.
This limit does not apply to death or personal injury caused by our fault, to damage caused intentionally or through gross negligence, to fraud, or to anything else that cannot lawfully be limited (Civil Code Article 6.252). It also does not apply to money you have won or staked: prizes and refunds we owe you are debts, not damages, and they are payable in full.
11. User Responsibility
Users agree to:
- Exercise safely
- Follow local laws
- Submit evidence honestly
- Not manipulate their weight dangerously
- Not cheat
- Maintain accurate subscriber and payout details
- Use the app responsibly
12. If someone claims against us because of something you did
If you break these rules or the law, and someone else brings a claim against us because of it, you agree to cover the reasonable costs we actually incur in dealing with that claim. This covers things like breaking the challenge rules, cheating or fraud, misusing the app, and using content you did not have the right to use.
This applies only where the claim arises from something you did deliberately or carelessly. It does not apply to anything caused by our own acts or omissions, and it does not apply where you acted in good faith and in line with these rules. If such a claim is made, we will tell you promptly, we will not settle it in a way that creates an obligation for you without asking you first, and you can take part in defending it.
13. Amendment
This Risk Statement may be updated periodically. Users will be notified of material changes.
