Welcome to Motiw8, a platform where adults participate in skill-based fitness challenges using verified steps, weight measurements, and healthy-habit competitions. These Terms and Conditions ("Terms") explain how you use the app, enter challenges, submit evidence, receive payouts, and interact with other users.
By creating an account or using Motiw8, you agree to these Terms. If you do not agree, you must not use the app.

We operate globally. For users in the European Union and the rest of the world (except the United States), these Terms are governed by Lithuanian law, with disputes resolved in Vilnius, Lithuania. For users in the United States, certain disputes are resolved through binding arbitration under the American Arbitration Association (AAA) as described in Section 21.
Motiw8 is not a gambling service and does not offer games of chance. All challenge outcomes are based entirely on your verified fitness performance.
3. Eligibility & Age Requirements
To use Motiw8 you must:
- Be at least 18 years old;
- Be legally able to enter a binding contract in your country;
- Not be prohibited by applicable law from receiving payouts;
- Not be barred from using Stripe, Apple, Google, or similar financial services;
- Use the app only for personal, non-commercial fitness purposes.
You may not use Motiw8 if:
- You are under 18;
- You are using another person's identity or account;
- You attempt to create duplicate or fraudulent accounts;
- You attempt to manipulate challenge outcomes or bypass verification.
4. Your Account
You must provide accurate information, which may include:
- Email address or other login credentials;
- Date of birth and country;
- Accurate weight and steps when required for challenges;
- A selfie or biometric verification (for high-stakes challenges).
You agree to:
- Keep your password and login methods secure;
- Not share your account with other people;
- Not impersonate other users or entities;
- Not bypass verification, payout, or KYC processes.
We may suspend or close accounts involved in repeat violations, suspected fraud, cheating, chargeback abuse, or harmful behavior towards other users or the platform.
5. Health & Safety Disclaimer
Motiw8 is a fitness accountability tool, not a medical program or a substitute for professional healthcare.
By participating in challenges, you confirm that:
- You are in suitable health to perform physical activity and weight loss;
- You understand that weight loss and exercise may involve risks;
- You will seek medical advice from a doctor or qualified professional if needed;
- You accept responsibility for your own fitness, diet, and health decisions.
We do not provide medical advice, diagnosis, or treatment. You must not use Motiw8 if weight loss or intense exercise could harm your health based on medical advice or known conditions.
6. How Motiw8 Challenges Work
Motiw8 offers different types of challenges, including:
- Weight-loss challenges based on percentage weight loss;
- Steps challenges based on verified steps from connected services;
- Premium challenges with enhanced scoring and stricter verification;
- Stake-based contests where winners receive payouts;
- Free challenges for practice or fun.
Typical challenge phases:
- Join a challenge;
- Pay a stake (if required);
- Submit a baseline (weight or steps) before the challenge starts;
- Complete optional weekly check-ins;
- Submit final proof at the end of the challenge;
- Undergo verification and review;
- Receive a ranking and payouts (if applicable).
General timelines (exact values may vary per challenge):
- Baseline: Required within a specified period before challenge start;
- Weekly check-ins: Typically every 7 days during the challenge;
- Final submission: On or close to the challenge end date, within the allowed submission window.
6.1 Verification & Evidence Requirements
For premium challenges that require body fat percentage verification, the following requirements apply:
- Definition of Verification Evidence: Baseline and final body-fat tests must come from the same certified laboratory using the same measurement method. The official lab report must include the user's full name, test date, laboratory name and contact information, and measured fat percentage.
- Photo/Scan Format Requirements: Submitted proof must be a scanned or photographed official laboratory report that is legible and unaltered. The document must clearly show all required information.
- License to Contact Lab: By participating in a premium challenge requiring lab documents, you consent to Motiw8 contacting the issuing laboratory to verify the authenticity of the report and confirm that it corresponds to you and has not been falsified. This contact is limited to verification purposes only—we will not request broader medical records.
- Consequences of Verification Failure: Without verified proof, you cannot be declared a winner. If you refuse verification or fail to provide required data, Motiw8 may disqualify you and award the prize to the next eligible, verified participant. Your stake may be forfeited in accordance with these Terms.
7. Stakes, Fees & Payouts
7.1 Stakes
Some challenges require you to pay a stake to participate. This is a participation fee in a skill-based competition, not a wager in a game of chance.
7.2 Platform Fees
Platform fees may apply as follows:
- Standard users: around 10% platform fee on stakes;
- Premium users: may receive reduced or zero platform fees on stakes.
Actual fees are shown clearly in the app before you confirm payment and may change over time with appropriate notice.
7.3 Payouts
After a challenge ends and all evidence is verified, a prize pool is distributed to winners based on:
- Verified performance;
- Challenge-specific rules;
- Final rankings and scoring methods.
Payouts are handled via Stripe Connect. Funds typically move from Motiw8's Stripe platform account to your Stripe Express account and then to your bank account using Stripe's payout tools.
7.4 Taxes
You are responsible for reporting income and paying any applicable taxes in your country. Payouts may be considered taxable income.
In the United States, you may be subject to forms such as 1099-K or other reporting requirements if your payouts exceed certain thresholds. Stripe or other payment processors may perform some reporting automatically.
In the European Union, VAT on subscriptions is typically handled by the App Store or Google Play. Winnings and prize income remain your own responsibility to declare.
8. Refund Policy
8.1 Stakes
You may request a refund of your stake within 24 hours after paying the stake, provided the challenge has not yet started.
After this window:
- No refunds are provided for stakes;
- No exceptions are made once the challenge has started.
If a challenge is cancelled or fails to start (for example, not enough participants), participants will receive automatic refunds for their stakes.
8.2 Subscriptions
Subscription purchases and refunds are managed by the Apple App Store and Google Play Store via RevenueCat. Their rules apply. We cannot override or change store-level refund decisions.
9. Subscriptions
Subscription features may include:
- Access to premium challenges;
- Reduced or zero platform fees on stakes;
- Enhanced analytics and insights;
- Priority or early access to new challenge types;
- Additional app features and tools.
All subscription payments are handled through the Apple App Store and Google Play Store, using their in-app purchase systems.
Subscriptions renew automatically until canceled. You can cancel through your Apple or Google account settings. Deleting the app does not cancel your subscription.
10. Evidence You Must Submit
To participate in and complete challenges, you may be required to submit different types of evidence, such as:
- Scale photos showing your weight clearly on the display;
- Full-body photos of you on or near the scale;
- Short verification videos (for example, 3–10 seconds) demonstrating weigh-in;
- Timestamp screenshots (showing date and time);
- Weekly progress photos or additional proof for check-ins;
- Final weigh-in videos or photos at the end of the challenge.
Video and more advanced checks are usually required when stakes are at or above certain thresholds (for example, ≥ €50 / $50) or when suspicious activity is detected.
All evidence must be:
- Taken by you, featuring you (and not another person);
- Taken on the correct date, within the allowed submission window;
- Clear, readable, and unedited;
- Not reused from previous days or challenges;
- Submitted through the app's camera and upload tools.
We may reject evidence that is blurry, manipulated, missing timestamps, clearly reused, or appears to belong to another person.
11. How Verification Works
Motiw8 uses a combination of automated and manual tools to verify your evidence, including but not limited to:
- AI services such as AWS Rekognition;
- Optical character recognition (OCR) to read scale numbers;
- Liveness detection to confirm real person presence in videos;
- Face comparison between baseline and final submissions;
- Content moderation to detect inappropriate content;
- Metadata checks (EXIF data, timestamps, device information);
- Manual review by Motiw8 reviewers for edge cases.
AWS may store mathematical face vectors for comparison, but original images are stored in Motiw8's storage (Supabase) and not permanently in AWS Rekognition.
Typical retention periods include:
- Photos (evidence images): retained for around 180 days after challenge end;
- Videos (evidence clips): retained for around 90 days after challenge end;
- Face vectors or derived biometric data: may be retained for up to 36 months;
- Financial and audit logs: retained for up to 7 years for compliance.
High-stakes challenges (for example, stakes ≥ €50 / $50) require biometric consent before using liveness and face comparison features.
12. Anti-Cheat & Fair Play Rules
You agree not to:
- Fake or manipulate weigh-ins;
- Submit someone else's photos or videos as your own;
- Edit or tamper with images, videos, or metadata;
- Reuse evidence from earlier dates or other challenges;
- Submit unrealistic or impossible weight changes;
- Manually enter fake steps or artificially manipulate step counts;
- Use bots, scripts, or unauthorized tools to influence data;
- Access the app in ways intended to bypass verification or scoring;
- Submit lab documents from different laboratories for baseline and final submissions (premium challenges);
- Refuse to consent to lab verification contact when required;
- Submit falsified or manipulated lab documents.
Automatic flags for review may include:
- Large sudden weight changes over very short time periods;
- Repeated EXIF metadata mismatches or missing EXIF data;
- Face mismatches between baseline and final submissions;
- Reused or duplicate photos across multiple dates;
- Non-human or inappropriate content in evidence;
- Timestamp inconsistencies between screenshots and weigh-in;
- Device inconsistencies or unusual upload patterns.
We may, at our discretion:
- Reject individual submissions;
- Disqualify users from specific challenges;
- Forfeit stakes for users found to be cheating;
- Ban users temporarily or permanently;
- Block devices or accounts suspected of fraud.
13. Verification Failure Consequences
If verification fails or if you refuse to provide required verification data or consent:
- You cannot be declared a winner without verified proof;
- Motiw8 may disqualify you from the challenge;
- The prize will be awarded to the next eligible, verified participant;
- Your stake may be forfeited in accordance with these Terms and the challenge rules.
This applies to all types of verification, including photo/video evidence, lab document verification, and any other verification methods required by the challenge.
14. Disputes, Appeals & Re-Checks
If your submission is rejected or your result is disputed, you may request a manual review where available in the app.
In such cases, you may be asked to:
- Provide additional evidence;
- Explain irregularities;
- Submit a new verification photo or video.
Final decisions regarding verification and results are made by Motiw8's internal review team, taking into account fairness, evidence, and overall platform integrity.
15. Payouts & Withdrawals
When a challenge ends, the following steps generally occur:
- Verification: Final submissions undergo AI verification, metadata checks, and manual review where needed.
- Ranking: Scores and rankings are calculated based on challenge rules and verified results.
- Prize Distribution: Prize pools are allocated to winners based on final rankings.
Payout conditions:
- You must provide accurate identity and payout information;
- You must have a valid Stripe Express account or supported payout method;
- You may be required to pass KYC checks for certain payout levels;
- You must not be banned, suspended, or under investigation for fraud;
- Your country must be supported by Stripe for payouts.
KYC / AML triggers may include:
- Payouts above certain thresholds (for example, ≥ €600 / $600);
- Unusual or high-risk activity on the account;
- Flags from payment processors or regulators;
- Repeated chargebacks or disputes.
If a payout fails or is reversed (for example, incorrect bank info), you will be notified and may need to correct your payout details. Motiw8 is not responsible for failed payouts caused by incorrect user information or bank errors.
16. User Conduct
You agree not to:
- Harass, threaten, or insult other users or staff;
- Spread misinformation, spam, or unsolicited advertising;
- Share explicit, hateful, or illegal content;
- Use automated tools, bots, or scripts with the platform;
- Reverse-engineer or hack any part of the service;
- Upload content that violates any laws or third-party rights;
- Attempt to circumvent verification, location, or security features;
- Misuse support or report tools in bad faith.
Violations may result in:
- Warnings;
- Feature limitations;
- Temporary suspension;
- Permanent account closure;
- Forfeiture of stakes in severe cases;
- Legal action when necessary.
17. Intellectual Property
All intellectual property rights in the Motiw8 platform belong to Motiw8 UAB or its licensors, including:
- Brand names, logos, and trademarks;
- App design, user interface, and user experience;
- Software code, algorithms, and verification models;
- Challenge formats and scoring systems;
- Educational materials and in-app content.
You may not:
- Copy, modify, or distribute the app or its content without permission;
- Sell, lease, or sublicense access to the platform;
- Use our trademarks without written consent.
You retain ownership of your own photos, videos, and content, but grant Motiw8 a limited license to use them solely for operating the service, including verification, fraud detection, and moderation.
18. Health, Fitness & Weight-Loss Risks
By using Motiw8, you acknowledge that:
- Weight loss is not guaranteed;
- Your results depend on your own efforts and behavior;
- Rapid or extreme weight changes can be dangerous;
- You should consult a doctor before major changes to diet or exercise;
- Weigh-ins and evidence submissions may involve frequent weighing and photos.
Motiw8 is not liable for injuries, health complications, or adverse outcomes arising from your use of the app or from your fitness and nutrition decisions.
19. No Gambling Disclaimer
Motiw8 challenges are skill-based fitness competitions, not games of chance.
Outcomes depend on:
- Your verified steps or weight loss;
- Your consistency and participation;
- Objective scoring rules applied to all participants;
- Transparent verification and anti-cheat tools.
There is no element of chance determining who wins.
As a result:
- Gambling laws and licenses generally do not apply to Motiw8 challenges;
- Payouts are considered performance-based prizes, not gambling winnings.
20. Termination & Suspension
We may suspend, restrict, or permanently close your account if we believe you have:
- Violated these Terms;
- Committed or attempted fraud or cheating;
- Submitted repeated invalid or suspicious evidence;
- Engaged in chargeback abuse or payment fraud;
- Harassed others or misused platform features;
- Attempted to manipulate payouts or challenge outcomes;
- Engaged in other behavior that undermines the integrity of the platform.
You may delete your account at any time within the app. Certain data, especially financial and audit records, may be retained for up to 7 years for legal and compliance reasons, even after account deletion, as described in our Privacy Policy.
21. Tax Responsibilities
Earnings through Motiw8 challenges may be considered taxable income under the laws of your country.
You are responsible for:
- Tracking your winnings and payouts;
- Determining how they are taxed in your jurisdiction;
- Reporting them correctly to tax authorities;
- Consulting a tax advisor if needed.
In some regions, payment processors or platforms may report income to tax authorities once certain thresholds are exceeded (for example, $600/year in the U.S. for 1099-K reporting). Such reporting does not replace your own duty to comply with tax laws.

22. Dispute Resolution & Arbitration
22.1 Non-U.S. Users
For users outside the United States, these Terms and any disputes arising from or related to them are governed by the laws of Lithuania, without regard to conflict-of-law principles.
Any disputes will be resolved exclusively by arbitration in Vilnius, Lithuania, under the rules of the Vilnius Court of Commercial Arbitration or similar recognized arbitration institution. Proceedings are individual only; class actions or collective proceedings are not permitted.
22.2 U.S. Users
For users located in the United States, you agree that most disputes will be resolved through binding arbitration by the American Arbitration Association (AAA), rather than in court.
Key points:
- No class actions or class arbitrations are permitted;
- No jury trial is available;
- Claims must be brought individually;
- Claims must generally be filed within 12 months of the event.
22.3 Exceptions
The arbitration requirements do not apply to:
- Intellectual property disputes (for example, misuse of our trademarks);
- Requests for temporary or permanent court injunctions;
- Debt collection actions or payment enforcement;
- Actions brought by regulators or governmental authorities.
23. Limitation of Liability
To the maximum extent permitted by law, Motiw8 and its affiliates are not liable for:
- Loss of earnings or lost profits;
- Health issues or injuries related to exercise, diet, or weight loss;
- Incorrect or incomplete evidence submissions;
- Delayed, failed, or reversed payouts not caused by our fault;
- Loss or corruption of data;
- App downtime, outages, or bugs;
- Third-party service outages (Apple Health, Google Fit, Stripe, RevenueCat, AWS, Supabase, Vercel, etc.);
- Verification errors caused by poor-quality or misleading user submissions.
Where liability cannot be fully excluded, our total aggregate liability to you for all claims under these Terms is limited to the greater of:
- The total amount you paid to Motiw8 in the 3 months before the claim; or
- €100 (or equivalent in local currency).
24. Indemnification
You agree to indemnify and hold harmless Motiw8 UAB, its directors, employees, and partners from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of:
- Your use or misuse of the app;
- Your breach of these Terms;
- Your violation of any laws or third-party rights;
- Your submission of unlawful, fraudulent, or harmful content;
- Your attempts to cheat, manipulate results, or abuse payouts;
- Your disputes with other users.
25. Changes to These Terms
We may update these Terms from time to time to reflect changes to our services, legal requirements, or business practices.
When we make changes, we will:
- Update the "Effective Date" and version number at the top;
- Publish the updated Terms in the app or on our website;
- Notify users via in-app notification or email where appropriate.
Your continued use of Motiw8 after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the new Terms, you should stop using the app and may delete your account.
